give it up lady. its on tmz so i'm not gonna post it but the person suing miley claims that Justin is an adult and should have kept Miley's behavior in check.
heres what is says:
According to the amended lawsuit, Miley's parents gave Justin authority to "supervise, manage, guard, and oversee [Miley's] conduct while in [his] presence."

I have a hard time believing that her lawyer wouldn't have been competent enough to have included some of the adults in the photo as codefendants in the original complaint. Maybe this is their last ditch response to the judge mentioning her status as a minor as one of the many reasons he thought the case was flimsy.

The initial lawsuit is baseless. Granted, I'll give the plaintiff credit for a rather, "creative" interpretation of the Unruh Act but it's baseless none the less.
I could go into a long boring legal analysis here but suffice to say, they are suing here under a California law that makes it illegal for businesses that offer services to discriminate. While Miley does have a legal business (Smiley Miley Inc) to represent her interests, the business does not exist to serve the public (merely to represent her in business matters) and her actions are not considered a public service, especially when done in private.

If you are a minor and left with someone over 18 I believe they are your guardian for the time being.

Doesn't change the fact that it's an assumption that they put Justin in charge. Even if he was, the claim that he is responsible is bogus.

just because you are a minor and left with an 18+ year old doesnt make them your guardian. im 17 and my older 18+ brothers and sisters - family - are not my legal guardians. im 17 and i cant even go to the dentist with my 21 year old brother alone, my mom or dad needs to be there =\ it has to be your parent or legal guardian, someone 18+ doesnt matter at all.
and im pretty sure there has to be some sort of documentation and legal shiz to make justin mileys legal guardian so unless that lady has that documentation, shes got nothing on him. in most cases, someone is appointed a legal guardian either from a will, or a court actually appoints someone. usually this spawns from parental problems and the court deems the parents unfit to take care of the child and a legal guardian is appointed. if justin was mileys legal guardian, he would basically be like a parent to miley - he is supposed to take care of miley and her property/assets. im sure the media would have jumped on this a long time ago if justin had such.
the fact that this lawsuit has gone on this far baffles me tho. everyone in their right mind knows mileys side will win this. the asian lady just wanted a quick paycheck or to damage mileys image and neither has really happened. mileys image was a lil dented from this whole thing, but it has blown over and not the whole public knows about it like her past "scandals". and the asian chick will prolly be the one losing money, im sure at the least she'll have to pay mileys legal bills for this frivolous case.
