As we read Unruh, it is essentially aimed a bricks-and-mortar establishment doing business in the State of California. It establishes that it is not permitted to deny anyone on the basis of race, gender or profile. An example is; if you’re running a restaurant, you can’t refuse to serve someone simply because they are a specific ethnic group or background. It doesn’t say anything about individuals ...

But the statements Judge Hess made in the pre-hearing seem to indicate he’s in agreement with the principal of this counter-filing. He’s shown he already has a dim view of the whole proceeding, so he may allow sanctions. If they can get awarded even half of the $58K they are asking for, that would be a pretty good spanking.

Agreed, this was always how it would end. And I take it poor old Lucie Kim will have to pay all these herself if it goes ahead? Well, she was asking for it the whole way through, I genuinely can't see how she could have thought she might actually manage to get 4 billion dollars out of Miley. Then again, it's not over yet, we could all get a slap in the face and Miley might suddenly be in massive amounts of debt. Somehow I doubt it though :)

^^ They knew that they would never get a $4 Billion award. But if they were able to win, they would set precedent. I believe that is what they were really after, as they could use it as a basis to file a national suit. From anything we have been able to find, Lucie Kim’s counselor does nothing but Class Action suits. He’s probably working on contingency, so she may not be paying him anything. But if the Judge orders sanctions, someone will have to pay it. If he does, I’ll be laughing so hard I’ll need oxygen! Just deserts ...

So you're suing Miley Cyrus, claiming she defamed 1,000,000 Asian Pacific Islanders in L.A. County by taking a picture while making squinty eyes ... so how do you gain favor with the judge -- call him a racist.

Lucie Kim and her lawyer, Henry Lee (not the OJ Simpson forensics dude Henry Lee) claim the judge crossed the line in a hearing last week by repeatedly referring to Asians as "oriental." They say the word "oriental" is "an offensive, derogatory racial insult to persons of Asians descent ... akin to using the word N---er.

Kim and Lee want Judge Robert Hess to remove himself from the case.

I eat oriental food which is usually Chinese or anything Asian really. I feel stupid because I've never heard anyone call the asian group that.

This seems like a ridiculous case. I don't think miley is the only person who has ever done that. And I don't think she is the only famous person who has ever done that or make some other kind of racist looking picture.

Some people will find oriental offensive, others find asian offensive, you can't speak on behalf of everyone in your race to say that a word is offensive, unless it's well established as such, like the n word. If she found it offensive, okay, she could have just said to the judge that she'd prefer to be called an asian woman, but for god's sake, her reputation is already in tatters, this is just completely transparent.
People like her honestly do make me sick, using their race, sexuality, disability, whatever to take advantage of other people.

I get the feeling that they are trying to drag this on for as long as possible. I believe there is a hearing on the 15th of this month to determine the admissibility of the suit and another hearing on the 30th for the attorney charges. hopefully this may be finally coming to a close.

I don't know when they will rule on the judge recusing himself.
